These Terms & Conditions ("Terms") govern your use of NotifyBulk, a multichannel messaging platform operated by Nodes Smart Solutions LLC (494 E Elizabeth Day Cv, Draper, Utah 84020, USA). By creating an account or using the service you agree to these Terms.

1. The service

NotifyBulk is a cloud-based platform that lets registered businesses send SMS, WhatsApp and email messages and surveys to their own opted-in contacts, and automate their communications.

2. SMS / text messaging program

Program name: NotifyBulk Account Notifications. When you provide your mobile number and opt in at signup, NotifyBulk sends you account, service and security notifications — such as one-time verification (2FA) codes, low-balance and billing alerts, payment receipts, and account or security updates.

  • Message frequency varies based on your account activity.
  • Message and data rates may apply.
  • For help, reply HELP or contact [email protected].
  • To stop receiving messages, reply STOP at any time. You will receive one confirmation message and then no further texts.

Carriers are not liable for delayed or undelivered messages.

3. Your responsibilities as a sender

If you use NotifyBulk to message your own contacts, you are solely responsible for:

  • Obtaining prior express consent from every recipient before sending any message, and keeping records of that consent.
  • Providing a clear and easy opt-out mechanism in every campaign and honoring opt-out requests.
  • Complying with all applicable laws and carrier rules (including TCPA, CTIA guidelines and local regulations).

4. Acceptable use

You may not use the platform to send unlawful, deceptive, or prohibited content (including, where restricted by carriers, content related to illegal substances, hate, fraud, or high-risk financial offers). We may suspend accounts that violate these Terms or carrier policies.

5. Billing

Paid plans and message credits are billed through our payment processor (Stripe). Fees are described at the time of purchase. Carrier and third-party charges are passed through where applicable.

6. Disclaimers and limitation of liability

The service is provided "as is". To the maximum extent permitted by law, Nodes Smart Solutions LLC is not liable for indirect or consequential damages, for carrier filtering, or for delayed or undelivered messages. Our aggregate liability is limited to the amount you paid for the service in the prior three months.

7. Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

8. Changes

We may update these Terms from time to time. The updated version will be posted here with a revised "Last updated" date. Continued use after changes constitutes acceptance.
